Highlights

The 4 Types of Housing

Tourist/Business/Hotel Residence

This investment is one of the oldest models in the managed real estate sector, particularly under the LMP and LMNP schemes. Originating with tourist residences, it has gradually diversified to include:

  • tourist residences (coastal and mountain);
  • downtown business residences;
  • the gradual integration of the hotel industry as an investment product.

This evolution explains the scale of the phenomenon and the enduring enthusiasm of many individual investors. Its appeal also stems from an incentive-based tax framework, which allows, at a minimum, for the recovery of VAT and, in some cases, access to tax reduction schemes such as the Censi-Bouvard.

Student Housing

This investment represents a traditional pillar of managed real estate, which emerged shortly after vacation rental properties and is recognized for its long-term resilience, particularly over a twenty-year horizon. It is based on a proven model:

  • a commercial lease entered into with a single operator;
  • the payment of a fixed rent, regardless of occupancy rates;
  • predictable and stable income for the investor.

Its appeal is enhanced by a favorable tax regime, including VAT recovery upon acquisition and, in some cases, access to income tax reduction schemes, such as the Censi-Bouvard.

Senior Living Community

This investment plays a significant role in the world of managed residential properties and is undoubtedly the most recent segment to emerge, following tourism and student housing. Its development has accelerated over the past fifteen years, with marked growth over the last decade.

It is based on a now well-established model:

  • a commercial lease entered into with a single operator;
  • the payment of a fixed rent;
  • VAT recovery upon acquisition;
  • and, in most cases, a tax incentive program.

Nursing Home

This investment also falls within the traditional framework of managed real estate, based on a commercial lease entered into with an operator. The nursing home sector, however, is going through a period of instability, exacerbated by scandals that have gone beyond purely economic considerations to raise major human and ethical issues.

In this context, our firm has developed specific expertise, particularly regarding:

  • the risks of site abandonment;
  • issues related to the operator’s relocation;
  • projects to repurpose facilities.

FAQ

Frequently Asked Questions

What happens if my service provider is placed in receivership?

When a business operator is placed under court-supervised reorganization, a court-appointed administrator is designated to manage the company during the reorganization proceedings. It is therefore essential to act promptly to protect your rights within the insolvency proceedings, particularly with regard to the continuation or termination of the commercial lease. A court-appointed representative, for their part, will be responsible for representing the creditors’ interests during the proceedings.

Can I claim a VAT refund on my investment in a serviced residence?

When investing in an assisted living facility under the LMP or LMNP tax regimes, the purchaser is, at a minimum, eligible to claim a VAT refund at the time of purchase. Depending on the specifics of the transaction, additional tax incentives may also apply, including certain income tax reduction schemes—such as the Censi-Bouvard program—which further enhance the financial appeal of this type of investment.

What is a rent judge?

The commercial rent tribunal is the court with jurisdiction to determine the rental value of a property under a commercial lease, particularly when the lease is renewed or revised. A case brought before this tribunal resolves disputes between landlords and tenants regarding the amount of rent.

How does a class-action lawsuit work?

Collective defense brings together investors facing the same challenge so they can pool their resources and present a unified position to the operator or agent. This approach strengthens the investors’ position in the proceedings and maximizes their chances of achieving a favorable outcome.
